Terms of service
These terms are the agreement between Mycroscope and the organisation that opens an account, and they also apply to each person who signs in. By creating an account, installing the desktop app, or paying for a plan, the organisation agrees to these terms and to the privacy policy.
The organisation must have authority to bind itself. The person who creates the account must be allowed to do that for the organisation.
1. The service
Mycroscope provides a website, a signed-in app, and a Windows desktop app that record computer activity the organisation has described in its monitoring notice. Reports, goals, alerts, and exports are produced from that record. Features depend on the plan. A feature that is not in the plan is hidden.
Mycroscope does not photograph the screen, does not give legal, human-resources, or payroll advice, and does not decide whether monitoring is lawful for the organisation. The figures show what was recorded. They are not a finding about a person’s conduct.
2. Accounts and the desktop app
The owner creates the organisation and invites people. Each person activates the desktop app with an activation code and the company install key. The organisation must keep the install key inside the company. Sharing it lets another computer join the account.
The organisation is responsible for the people it adds, the roles it gives them, and the settings it publishes. Managers see only the people their role allows. Employees can see their own activity. The owner can require two-factor login for managers. Each person must keep their password and authenticator private.
Recording follows the current monitoring notice. The employee is asked to acknowledge that notice. Changing what is collected publishes a new notice, and people are asked to acknowledge the new version.
3. The organisation’s duties
The organisation will:
- Use Mycroscope only where it has a lawful basis, and tell the people being recorded, including through the monitoring notice.
- Name an information officer in the product when it is required to have one, and handle access, correction, and objection requests from its people.
- Not use the product to collect information the notice does not describe.
- Not upload unlawful content, attack the service, or try to view another organisation’s data.
- Keep at least one owner who can be reached about billing and the account.
4. Plans and payment
The current prices are on the pricing page. They are per seat, per month, before VAT. At checkout the owner chooses how many seats to buy. A seat is charged once for a year: monthly price × 12, and 15% VAT is added when VAT is on. A seat added later has its own year and its own end date. Removing a seat waits until that date, and the unused time is not refunded. The card payment is taken on a hosted payment page. Returning to the site is not proof that the payment succeeded. The seats are added when the payment provider confirms it.
- Free is R0, for up to 3 active people, and keeps 30 days of activity.
- Moving from Free to a paid plan charges a full year. The year starts when the payment is confirmed.
- Moving to a higher paid plan during the year charges the price difference for the days left. The end date stays the same.
- A downgrade or cancellation takes effect at the end of the paid year. Amounts already paid are not refunded.
- If a renewal is not paid, the paid plan stays for 7 days and the account then moves to Free. People above the Free limit are paused. They are not deleted.
- Work Activity Tracking and Workforce Management keep 6 months of activity. Productivity Optimization keeps 12 months. The owner may set a shorter period. A shorter period hides older activity.
The organisation will pay amounts that are correctly charged. If a payment is reversed after the plan was opened, Mycroscope may return the account to the state that matches the payments that still stand.
5. Customer data
The organisation keeps its rights in the activity and the other records it puts into Mycroscope. It gives Mycroscope permission to host, back up, and display that information only so the service can run, including through the providers named in the privacy policy.
Mycroscope staff do not read activity contents. A time-limited support view, if the organisation turns it on, shows agent status only. The organisation can ask for the account to be deleted after the subscription is cancelled. Deletion removes the people, activity, policies, audit history, and logins for that organisation, and it cannot be undone.
6. Mycroscope’s rights
Mycroscope owns the software, the website, the desktop app, and the written materials around them. These terms do not sell that ownership. The organisation receives a right to use the service for its own workforce while the account is open and these terms are kept. It may not copy the software for resale, or remove notices from the installer.
7. Availability
Mycroscope aims to keep the service available, but it is not promised to be uninterrupted. Maintenance, a failure of a provider, or a suspension under these terms can stop recording or sign-in for a time. The desktop app records on the computer and sends activity when it can reach the service.
8. Suspension and ending
Mycroscope may suspend an organisation that does not pay, that breaks these terms, or that uses the service in a way that puts other customers or the service at risk. A suspended account can still open existing data and cannot record new activity until it is set back to active.
The organisation may cancel. Recording continues until the paid-until date if that date is still in the future. After that, the account is read-only. Cancellation does not refund the current year.
9. Liability
To the extent the law allows, Mycroscope is not liable for lost profits, lost savings, or indirect or consequential loss, or for a decision the organisation makes about a person from a report. Mycroscope’s total liability arising out of the service in a year is limited to the fees that organisation paid to Mycroscope for the 12 months before the claim. If the organisation is on Free, that cap is zero rand.
Nothing in these terms limits liability for fraud, or for harm that South African law does not allow a contract to exclude. If the Consumer Protection Act applies to the organisation and gives a right these terms cannot take away, that right remains.
10. The organisation protects Mycroscope
The organisation will cover Mycroscope against a claim by one of its people, or by a regulator, that arises from the organisation’s monitoring, its notice, or its use of a report, except to the extent Mycroscope caused the claim by failing to run the service as these terms and the privacy policy describe.
11. Law
These terms are governed by the law of the Republic of South Africa. The courts of the Republic of South Africa may hear a dispute. The parties should first try to resolve a dispute through the support form.
12. Changes
Mycroscope may update these terms by posting a new version on this page with a new effective date. Continued use after that date is acceptance of the new terms. A change to price applies to the next year, or to an upgrade, and is shown before payment.
